Open Road Scotland Rental Terms

Contained below are our terms and conditions regarding the hire of our Motorhomes. If there are any queries regarding this or any other aspect of your hire, please contact us and we will do our best to answer your questions.

In these terms and conditions “Open Road Scotland” means Open Road Motorhomes Limited, a company registered in Scotland with company number SC335086 and having its registered office at Unit 12 Airlink Industrial Estate, Inchinnan Road, Paisley, PA3 2RS and “Hirer” means the person or persons who hire a vehicle from Open Road Scotland under these terms and conditions of rental.

Booking and Payment

To secure the rental of a motorhome (the “Vehicle”) for a requested rental period, a deposit of twenty five (25) per cent.of the total rental cost must be paid after confirmation of availability. Four (4) weeks prior to the commencement of the rental period, the remaining balance must be paid. Where bookings are made within four (4) weeks of commencement of the rental period, the full rental price must be paid at the time of booking. The Vehicle will not be released before payment and receipt by Open Road Scotland of the full rental cost.

Payment can be made be credit card / debit card / cheque / wire transfer.

Security Deposit

On renting the Vehicle a twelve hundred pound (£1200) security deposit is required to be secured by credit card, debit card or cash. Should the security deposit be paid by credit card, the amount will be debited from your account immediately. This is fully refundable within seven (7) days of return of the vehicle to the agreed location, on the agreed date and time, subject to these terms and conditions including but not limited to the return of the Vehicle in the same condition as it was let out, with the toilet cassette empty, the interior clean (including all cooking appliances), the fuel tank full.

Drivers and Insurance

Provided that the Vehicle is operated in accordance with these terms and conditions of rental the Hirer shall be insured at no additional cost under the Open Road Scotland’s motor vehicle insurance policy (the “Policy”). A copy of the Policy is available for inspection on request at the offices of Open Road Scotland. The Policy provides fully comprehensive vehicle cover in the United Kingdom.

The Policy does not provide insurance cover for any vehicle hired or driven by:

  • Persons under twenty three (23) or over seventy five (75) years of age unless otherwise agreed by the Policy insurer.
  • Persons aged twenty three (23) or over unless a full driving licence valid in the United Kingdom has been held for at least twenty four (24) months.
  • Persons who have been convicted of an offence in connection with the driving of a motor vehicle or motorcycle and / or have had their driving licence endorsed or suspended or penalty points imposed. (Parking and not more than than 2 speeding offences in the past 3 years may be ignored and ‘Spent’ convictions, covered by the Rehabilitation of Offenders Act 1974 may be disregarded).
  • Persons who have any pre-existing medical conditions, which affect driving ability.
  • Persons who have had their insurance declined and / or renewal refused and / or have had their insurance or cover cancelled by any motor insurer.
  • Persons engaged wholly or partly in professional entertainment or professional sports persons.
  • Jockeys and persons connected with racing of any sort.
  • Undergraduates and / or students under twenty three (23) years of age.
  • Persons who, whilst driving, have been involved in more than one accident during the past three (3) years.
  • Foreign service personnel other than persons born in the United Kingdom

Together referred to as “Prohibited Persons”

No Vehicle may be rented by or driven by a Prohibited Person. In the event of any breach of this term (whether or not fraudulently or negligently) or any other default on the part of the Hirer or other driver which results in Open Road Scotland being prevented or restricted from recovering in full under the Policy, the Hirer hereby indemnifies Open Road Scotland against any and all third party claims and losses in respect of the Vehicle including total loss and loss of use.

The Policy does not provide cover for loss of or damage to property or goods of the Hirer. The Policy does not cover the Vehicle for use outside the United Kingdom.

It may be necessary for referral to be made to the Policy insurers at the time of reservation to ensure that any endorsements meet with their criteria. All previous motoring convictions are to be disclosed to Open Road Scotland at the time of hiring. The Hirer acknowledges and agrees that this is a fundamental term of hire.

Each Hirer and any proposed driver individually has to complete the Policy insurer’s proposal form in the presence of a representative of Open Road Scotland and has to be accepted by the Policy insurer and Open Road Scotland as suitable to drive the Vehicle.

Two (2) proofs of identity must be produced on renting the Vehicle and it is a strict requirement of the Policy insurer that digital photographs of the Hirer and any additional drivers are taken at the time the Vehicle is rented.

Excess and Collision Damage Waiver

The Hirer is responsible for payment of the first twelve hundred pounds (£1200) of any insurance claim (the “Excess”).

Collision Damage Waiver (“CDW”) at a cost of ten pounds (£10.00) per day is optional. CDW will reduce the excess for any damage caused in a collision to either the Vehicle or third party property to £600. The Hirer will, however, be fully liable for replacement or repair to equipment, fixtures and fittings, windows, tyres or negligent damage to the vehicle. CDW is not limited in application during the Vehicle rental period and accordingly may apply in respect of multiple claims.

CDW will not cover impact damage caused by reversing the vehicle into objects such as cars, walls or other stationary objects, or for damage caused to the canopy of the vehicle by trees, barriers or bridges etc… In these instances damage is classed as negligence and full excess applies

Use of Vehicle

The Hirer must not take the Vehicle outside the mainland of Scotland, England and Wales without the written consent of Open Road Scotland. Hirers should note that foreign travel vehicle insurance is compulsory if the Vehicle is to be taken outside the United Kingdom and this has to be proposed to Open Road Scotland’s insurers at the time of reservation.

The Hirer must ensure that the Vehicle and its contents are used in a proper and careful manner for social and domestic purposes. In particular, the Vehicle is not to be used for or in conjunction with any race, competition or trial; for towing; for the carriage of goods or passengers; for hire or reward, or any other form of profit or remuneration; or for the carriage of goods of an explosive or hazardous nature.

The Hirer is required to keep the Vehicle under his/her control throughout the Vehicle rental period. The Hirer undertakes to keep the Vehicle locked at all times when unattended and to refrain from any action or omission which may prejudice the rights of Open Road Scotland to the Vehicle.

Title

The Vehicle and its contents are to remain the property of Open Road Scotland at all times and the Hirer shall not sublet, assign, loan, pledge or grant lien over the Vehicle or its contents.

Mileage

There is no charge for mileage.

Cancellation

In the event of cancellation of a reservation or booking by the Hirer, the following charges will apply:

  • Less than four (4) weeks notice 100% of rental cost
  • Four (4) to six (6) weeks notice 50% of rental cost
  • More than six (6) weeks notice an amount equal to the booking deposit

We will use all reasonable endeavours to re-hire the Vehicle to alternative hirers and if successful we may be able to reduce the above charges.

Open Road Scotland reserves the right to cancel a planned hire if the nominated drivers’ licenses are invalid or not in accordance with the applicable terms of the insurance Policy, or these terms and conditions during the Vehicle rental period. In such circumstances all sums paid to Open Road Scotland, except the security deposit, will be forfeited to us.

Availability

Open Road Scotland will use all reasonable endeavours to ensure that the Vehicle that you have booked is available at the agreed date and time. Occasionally, motorhomes are returned damaged and if the damage is too great for us to repair on time we may need to offer a substitute motorhome. If this is not acceptable to you, or no other motorhome is available, then we will refund all sums that you have paid. The liability of Open Road Scotland will be limited to the refund of monies paid and the Hirer will have no further claims against Open Road Scotland.

Smoking and Pets

Smoking is not permitted in any vehicle. Pets are not permitted in any vehicle other than the dedicated ‘pet friendly’ Motorhome and this must be booked in advance. An additional £50 cleaning charge applies to any hires for the ‘pet friendly’ Motorhome. Any breach of these terms will will result in a one hundred pounds (£100) charge which will be deducted from the security deposit.

Fuel, Oil, Gas and Tyres

The vehicle shall be supplied with a full tank of fuel and must be returned with a full tank of fuel. Failure to do so will result in the cost of filling the tank plus an additional charge of £30 being deducted from the security deposit. The engine oil, water levels and tyre pressures must be checked by the Hirer at least once a week during the Vehicle rental period. Damage to the tyres, no matter the cause, will be charged to the Hirer on return. One full gas cylinder will be provided with each hire. The Hirer is responsible for buying replacement gas cylinders as and when required.

Collection and Return

The Vehicle is available for collection from 2pm on first day of hire. Please allow a minimum of 30 minutes for the handover and completion of all necessary paperwork.

The Hirer acknowledges delivery of the Vehicle free from any defects or damage other than those as specified on the inventory sheet agreed at the date of commencement of the Vehicle rental. Subject to these terms and conditions the the Vehicle and its contents must be returned in the same condition as they were received at the commencement of the Vehicle rental by ten thirty (10:30) a.m. on the final day of the Vehicle rental period. The Vehicle must be returned clean and undamaged, otherwise Open Road Scotland reserve the right to apply charges as detailed within these terms and conditions. Collections and returns out with the times stated above must be agreed with Open Road Scotland by prior arrangement.

Any extensions to the Vehicle rental period must be notified to Open Road Scotland immediately. Failure to do so will mean that the Vehicle is being driven uninsured and illegally. Hirers are advised that failure to return the Vehicle on time may result in criminal and civil proceedings. Failure to return the Vehicle on the agreed date and time will incur a charge of one hundred and fifty pounds (£150) per day or part day, plus the daily Vehicle rental rate. Your cooperation in this matter is much appreciated and is essential to ensure that the Vehicle is ready and available for the next hire.

Cleaning

The Vehicle must be returned clean inside and in the same condition that they left the depot. The toilet cassette must be emptied and flushed out. A cleaning fee of one hundred pounds £100 will be applied to each of the above if this condition is not met.

Breakdown and Accidents

In the event of a breakdown or accident, the Hirer may contact the AA for roadside assistance using the contact and information detailed amongst the Vehicle rental documents. The Hirer may give permission for repairs or replacement of parts at a cost up to one hundred pounds £100. Open Road Scotland’s approval must be obtained in respect of repairs or replacement of parts at a cost in excess of one hundred pounds (£100). The money will be refunded on production of a valid receipt. Open Road Scotland is not responsible or liable for any consequential loss or expense subsequent to a breakdown or accident, although a refund of each day’s hire charge will be refunded for each full day’s loss of use of the Vehicle due to breakdown.

In the event of an accident involving the Vehicle

The accident must be reported immediately by telephone to the number provided at the point of hire. A complete accident report must be made out and handed to Open Road Scotland on return of the vehicle, including a sketch of the accident where possible. Police should be notified immediately if there is property damage or people are injured. All accidents and damage must be reported to Open Road Scotland as soon as possible by calling the contact number provided at the point of hire. Names, addresses, insurance details and vehicle information of all third parties must be obtained at the time of the accident and best endeavours must be made to obtain the names and addresses of any witnesses. The Hirer should not admit guilt or liability. The Hirer must not abandon the Vehicle without taking adequate steps to prevent further damage, loss or contravention of traffic regulations or the law of Scotland.

Every effort is made to ensure that the Vehicle is in a safe and roadworthy condition before it leaves the premises, but Open Road Scotland shall be under no liability for third party claims or damages arising in connection with, or as a consequence of, any breakdown or accident.

Penalties, Fines and charges

All fines incurred by the Hirer or other driver for the infringement of traffic laws or regulations shall be the liability of the Hirer or other driver and must be paid in full on receipt of any notice of penalty, fine or charge. Open Road Scotland will not be responsible for any such liabilities. If Open Road Scotland do receive any notices in respect of penalty, fines or charges including but not limited to fines and penalties for speeding, parking fines and congestion charges then an administration fee of twenty five pounds (£25.00) will be added to the penalty, fine or charge to cover administration and postage costs incurred to redirect such penalty notices, fines or charges.

Child Seats

Regulations govern the use of child car seats in the United Kingdom requiring every child traveling in the Vehicle to be seated using specified restraints in all circumstances where the child is under 135cm or 12 years of age. It is the Hirer’s responsibility to ensure that necessary child seats are used in the Vehicle if carrying children. Child seats are available free of charge from Open Road Scotland if required.

Limitation of Liabilities

We accept no liability for replacement vehicle costs, travel or accommodation costs or any other consequential loss claims arising from the breakdown of the Vehicle, fair wear and tear excepted, or any accident or other such related causes.

Open Road Scotland shall not be liable for any costs and expenses incurred for speeding, parking fines, congestion charges and for any other offences committed against the Road Traffic Act or traffic regulations or otherwise.

The Hirer shall be solely responsible for the costs of repair and or replacement as necessary in relation to damage to windscreen, tyres and punctures.

Car Parking

Car parking (at the risk of the Hirer) is offered free of charge to the Hirer at the premises of Open Road Scotland for the duration of the Vehicle rental period.

Other Terms

Open Road Scotland reserves the right to vary rates, conditions and specification without notice. Open Road Scotland also reserves the right to refuse hire to any person.

No failure or delay by Open Road Scotland in exercising any right, power or privilege under these terms and conditions shall operate as a waiver nor shall any single or partial exercise preclude any further exercise of any right, power or privilege under these terms and conditions or otherwise.

If any provision of these terms and conditions shall be found by any court of competent jurisdiction to be invalid or unenforceable in whole or in part, such invalidity or unenforceability shall not affect the other part of that provision or the other provisions of these terms and conditions which shall remain in full force and effect.

The interpretation of these terms and conditions and all rental agreements entered incorporating these terms and conditions shall be governed by and construed in accordance with the law of Scotland and the parties agree to submit to the exclusive jurisdiction of the Scottish courts.

 

Terms of booking on this website

The following terms relate to the booking service provided to you by Motorhome Republic. The booking service includes the Motorhome Republic site, the software associated with the site and the facility to enter into transactions with certain parties whose content appears on the site. You agree to these terms with us in respect of the booking service, in addition to the terms of your rental above which apply directly between you and your chosen third party travel provider (“Third Party Provider”).

Information disclaimer

The rates on this website are often heavily discounted. This is due to our negotiated rates and bulk buying power. On very rare occasions, a rate may be displayed incorrectly due to our, or a Third Party Provider’s error. In such a case, if you book with us at a quoted rate that is incorrect, we will notify you of any price change and give you the option to proceed or cancel. We make every effort to keep information on our site up to date, but we cannot guarantee this website is free of errors or omissions and retain the right to update or change the information published at any time.

Liability

To the extent permitted by law we/the owners of this website will not be liable to you or to any third party (whether in contract, tort, or otherwise) for any direct, indirect or consequential loss or damage or for any accident, injury, delay or loss of enjoyment arising out of your reliance upon information contained on this website, including but not limited to your use (or inability to use) any products or services described or procured through this website.

Your rental and use of a vehicle booked through our site will be governed by the terms of the rental agreement with the Third Party Provider. The rental agreement and any other documentation provided to you by the Third Party Provider is between you and the Third Party Provider and we will not be liable to you or to any third party in any way in relation to that agreement or your vehicle or rental service where your booking has been properly processed by us. We are not responsible or liable to you for (i) the acts or omissions of the Third Party Provider in respect of your booking or in the course of delivering the rental service to you; or (ii) any disputes in respect of your booking with that Third Party Provider or that service, except in each case to the extent that responsibility for those matters may be imposed on us by applicable law. While we will make reasonable efforts to ensure we are representing only reputable Third Party Providers, we make no warranty about the fitness suitability of any Third Party Provider product or service and will not accept responsibility for the quality fitness of any vehicle. If you encounter issues with the vehicle whilst on hire, you MUST report these issues directly to the relevant Third Party Provider at the earliest possible time. This will allow the Third Party Provider to remedy any issues and minimise any inconvenience to you. If you fail to report any vehicle issues during your rental, it is likely that compensation will not be offered. We welcome feedback from our customers on their experience with our Third Party Providers. We may, at our discretion, provide you with reasonable assistance in resolving any dispute you may have with a Third Party Provider. Where we are liable to you terms and conditions, our total liability to you will be limited to (at our option) resupply of the booking service provided to you or the dollar amount of the deposit we received from you in relation to your booking. Again, we strongly recommend that you take out travel insurance. Your use of this website is governed by the laws of New Zealand and the jurisdiction of the New Zealand courts.

Booking information

To make a booking you must complete our booking form which is easy to follow and secured with the latest encryption technology. Once we receive your form, we will availability confirm your booking email you a confirmation voucher and invoice. The deposit required to secure your vehicle (as shown on the secure booking page) will only be processed on your credit card when your booking is confirmed. Please note that a 2% credit card or debit card surcharge will be added when your payment is processed. A booking is confirmed when you have been emailed a confirmation voucher and at this stage the deposit is processed on your card and becomes non-refundable and any cancellation fees stated in the Third Party Providers terms apply. Upon receipt of your confirmation, please check your details carefully and notify us immediately if there are any incorrect details, as it may not be possible to make changes at a later date. If you are booking via phone, please make sure you have read the terms and conditions of the vehicle you wish to rent first. Our reservations consultant will ask you if you have read the terms and agree to them before proceeding. The onus is always on the renter to ensure they make themselves fully aware of the terms displayed on our website.

Information disclosure

In booking on this website you acknowledge that we disclose your information to your selected Third Party Provider in order for them to provide the requested rental services to you.

Amendments

Please note that some Third Party Providers treat an amendment as a new booking and apply the rate current at the time the amendment is made to recalculate the entire booking amount (not just the days changed). If the rental period is increased, an additional deposit may be required. If the rental period is shortened which results in a reduction of the rental charges, the deposit amount will remain unchanged, and the difference between the original and revised deposit is forfeited (it cannot be used towards remaining rental charges). To request a change to a confirmed booking, please use the alterations request link on your confirmation. Any alterations are subject to availability and the approval of the Third Party Provider. In addition to the alteration policy of the Third Party Provider stated in their terms, the following charges will apply in respect of our booking service relating to that amendment: Motorhome rental alterations (all charges stated in local currency): 25.00 The alteration fee will not be charged if your alteration request is not possible.

Vehicle Capacity and fitness to drive

Under no circumstances are you permitted to carry more passengers than the vehicle you rent is legally registered to carry, and if you do your insurance may be invalidated. The number of seatbelts (and passengers) is indicated next to each vehicle on this website. Luggage capacity where shown is an indication only and we will not be responsible should you be unable to fit your entire luggage into a vehicle. It is your responsibility to choose a journey that is within your capabilities. A Third Party Provider can refuse to rent a vehicle to any person who is in their opinion unfit to drive or does not meet eligibility requirements. In such circumstances we will have no further liability to you.

Refund and Cancellation Policy

We are committed to providing a quality service and aim for complete customer satisfaction. In the event of cancellation, any refunds, credits or cancellation charges that apply are detailed in the terms and conditions of the Third Party Provider of your selected vehicle. In the event you are unsatisfied with our booking service, please contact us within 48 hours of placing your booking or request and we will work to resolve any issues and determine if compensation is due. In the event you have completed your rental and are unhappy with your vehicle, we are happy to assist you in seeking compensation from the Third Party Provider.

Sometimes a booking may need to be cancelled because of circumstances beyond either party’s control. For example, a weather event, public health event (including epidemic / pandemic), medical emergencies, strike, terrorist act, governmental, regional or local authority restrictions (such as restrictions on movement due to the COVID-19 pandemic) or a change in law). If this occurs, your entitlement to a credit or refund will be as provided in your Third Party Provider’s terms and conditions.

You agree that you will raise and resolve any dispute over refunds or cancellations in respect of your booking (whether initiated by you, the Third Party Provider or by circumstances beyond the reasonable control of either party, including as a result of government travel restrictions, the COVID 19 pandemic or the insolvency of your Third Party Provider) directly with the Third Party Provider. Once you have made payment for your booking, you must not seek to reverse or cancel such payment through your card issuer or its agents without our prior consent.

We shall only be liable to provide a refund to you (whether that cancellation is initiated by you, the Third Party Provider or due to circumstances beyond the reasonable control of either party, including as a result of government travel restrictions, the COVID 19 pandemic or the insolvency of your Third Party Provider) to the extent that we actually receive a refund from the relevant Third Party Provider. Where refunds are due to you from a Third Party Provider, we will provide reasonable assistance to you in claiming such funds from that Third Party Provider. In that situation, you authorise us to seek such refunds from the travel provider directly and on your behalf.

Where a refund is applicable, the turnaround time from the date of your request for refund to the date you are provided with your refund may take up to 12 weeks. This is beyond our control.

We are not responsible (including in negligence) to you for any failure or delay on the part of any Third Party Provider in providing travel products to you where the booking has been properly processed.

Two (2) proofs of identity must be produced on renting the Vehicle and it is a strict requirement of the Policy insurer that digital photographs of the Hirer and any additional drivers are taken at the time the Vehicle is rented.

Excess and Collision Damage Waiver

The Hirer is responsible for payment of the first twelve hundred pounds (£1200) of any insurance claim (the “Excess”).

Collision Damage Waiver (“CDW”) at a cost of ten pounds (£10.00) per day is optional. CDW will reduce the excess for any damage caused in a collision to either the Vehicle or third party property to £600. The Hirer will, however, be fully liable for replacement or repair to equipment, fixtures and fittings, windows, tyres or negligent damage to the vehicle. CDW is not limited in application during the Vehicle rental period and accordingly may apply in respect of multiple claims.

CDW will not cover impact damage caused by reversing the vehicle into objects such as cars, walls or other stationary objects, or for damage caused to the canopy of the vehicle by trees, barriers or bridges etc… In these instances damage is classed as negligence and full excess applies

Use of Vehicle

The Hirer must not take the Vehicle outside the mainland of Scotland, England and Wales without the written consent of Open Road Scotland. Hirers should note that foreign travel vehicle insurance is compulsory if the Vehicle is to be taken outside the United Kingdom and this has to be proposed to Open Road Scotland’s insurers at the time of reservation.

The Hirer must ensure that the Vehicle and its contents are used in a proper and careful manner for social and domestic purposes. In particular, the Vehicle is not to be used for or in conjunction with any race, competition or trial; for towing; for the carriage of goods or passengers; for hire or reward, or any other form of profit or remuneration; or for the carriage of goods of an explosive or hazardous nature.

The Hirer is required to keep the Vehicle under his/her control throughout the Vehicle rental period. The Hirer undertakes to keep the Vehicle locked at all times when unattended and to refrain from any action or omission which may prejudice the rights of Open Road Scotland to the Vehicle.

Title

The Vehicle and its contents are to remain the property of Open Road Scotland at all times and the Hirer shall not sublet, assign, loan, pledge or grant lien over the Vehicle or its contents.

Mileage

There is no charge for mileage.

Cancellation

In the event of cancellation of a reservation or booking by the Hirer, the following charges will apply:

  • Less than four (4) weeks notice 100% of rental cost
  • Four (4) to six (6) weeks notice 50% of rental cost
  • More than six (6) weeks notice an amount equal to the booking deposit

We will use all reasonable endeavours to re-hire the Vehicle to alternative hirers and if successful we may be able to reduce the above charges.

Open Road Scotland reserves the right to cancel a planned hire if the nominated drivers’ licenses are invalid or not in accordance with the applicable terms of the insurance Policy, or these terms and conditions during the Vehicle rental period. In such circumstances all sums paid to Open Road Scotland, except the security deposit, will be forfeited to us.

Availability

Open Road Scotland will use all reasonable endeavours to ensure that the Vehicle that you have booked is available at the agreed date and time. Occasionally, motorhomes are returned damaged and if the damage is too great for us to repair on time we may need to offer a substitute motorhome. If this is not acceptable to you, or no other motorhome is available, then we will refund all sums that you have paid. The liability of Open Road Scotland will be limited to the refund of monies paid and the Hirer will have no further claims against Open Road Scotland.

Smoking and Pets

Smoking is not permitted in any vehicle. Pets are not permitted in any vehicle other than the dedicated ‘pet friendly’ Motorhome and this must be booked in advance. An additional £50 cleaning charge applies to any hires for the ‘pet friendly’ Motorhome. Any breach of these terms will will result in a one hundred pounds (£100) charge which will be deducted from the security deposit.

Fuel, Oil, Gas and Tyres

The vehicle shall be supplied with a full tank of fuel and must be returned with a full tank of fuel. Failure to do so will result in the cost of filling the tank plus an additional charge of £30 being deducted from the security deposit. The engine oil, water levels and tyre pressures must be checked by the Hirer at least once a week during the Vehicle rental period. Damage to the tyres, no matter the cause, will be charged to the Hirer on return. One full gas cylinder will be provided with each hire. The Hirer is responsible for buying replacement gas cylinders as and when required.

Collection and Return

The Vehicle is available for collection from 2pm on first day of hire. Please allow a minimum of 30 minutes for the handover and completion of all necessary paperwork.

The Hirer acknowledges delivery of the Vehicle free from any defects or damage other than those as specified on the inventory sheet agreed at the date of commencement of the Vehicle rental. Subject to these terms and conditions the the Vehicle and its contents must be returned in the same condition as they were received at the commencement of the Vehicle rental by ten thirty (10:30) a.m. on the final day of the Vehicle rental period. The Vehicle must be returned clean and undamaged, otherwise Open Road Scotland reserve the right to apply charges as detailed within these terms and conditions. Collections and returns out with the times stated above must be agreed with Open Road Scotland by prior arrangement.

Any extensions to the Vehicle rental period must be notified to Open Road Scotland immediately. Failure to do so will mean that the Vehicle is being driven uninsured and illegally. Hirers are advised that failure to return the Vehicle on time may result in criminal and civil proceedings. Failure to return the Vehicle on the agreed date and time will incur a charge of one hundred and fifty pounds (£150) per day or part day, plus the daily Vehicle rental rate. Your cooperation in this matter is much appreciated and is essential to ensure that the Vehicle is ready and available for the next hire.

Cleaning

The Vehicle must be returned clean inside and in the same condition that they left the depot. The toilet cassette must be emptied and flushed out. A cleaning fee of one hundred pounds £100 will be applied to each of the above if this condition is not met.

Breakdown and Accidents

In the event of a breakdown or accident, the Hirer may contact the AA for roadside assistance using the contact and information detailed amongst the Vehicle rental documents. The Hirer may give permission for repairs or replacement of parts at a cost up to one hundred pounds £100. Open Road Scotland’s approval must be obtained in respect of repairs or replacement of parts at a cost in excess of one hundred pounds (£100). The money will be refunded on production of a valid receipt. Open Road Scotland is not responsible or liable for any consequential loss or expense subsequent to a breakdown or accident, although a refund of each day’s hire charge will be refunded for each full day’s loss of use of the Vehicle due to breakdown.

In the event of an accident involving the Vehicle

The accident must be reported immediately by telephone to the number provided at the point of hire. A complete accident report must be made out and handed to Open Road Scotland on return of the vehicle, including a sketch of the accident where possible. Police should be notified immediately if there is property damage or people are injured. All accidents and damage must be reported to Open Road Scotland as soon as possible by calling the contact number provided at the point of hire. Names, addresses, insurance details and vehicle information of all third parties must be obtained at the time of the accident and best endeavours must be made to obtain the names and addresses of any witnesses. The Hirer should not admit guilt or liability. The Hirer must not abandon the Vehicle without taking adequate steps to prevent further damage, loss or contravention of traffic regulations or the law of Scotland.

Every effort is made to ensure that the Vehicle is in a safe and roadworthy condition before it leaves the premises, but Open Road Scotland shall be under no liability for third party claims or damages arising in connection with, or as a consequence of, any breakdown or accident.

Penalties, Fines and charges

All fines incurred by the Hirer or other driver for the infringement of traffic laws or regulations shall be the liability of the Hirer or other driver and must be paid in full on receipt of any notice of penalty, fine or charge. Open Road Scotland will not be responsible for any such liabilities. If Open Road Scotland do receive any notices in respect of penalty, fines or charges including but not limited to fines and penalties for speeding, parking fines and congestion charges then an administration fee of twenty five pounds (£25.00) will be added to the penalty, fine or charge to cover administration and postage costs incurred to redirect such penalty notices, fines or charges.

Child Seats

Regulations govern the use of child car seats in the United Kingdom requiring every child traveling in the Vehicle to be seated using specified restraints in all circumstances where the child is under 135cm or 12 years of age. It is the Hirer’s responsibility to ensure that necessary child seats are used in the Vehicle if carrying children. Child seats are available free of charge from Open Road Scotland if required.

Limitation of Liabilities

We accept no liability for replacement vehicle costs, travel or accommodation costs or any other consequential loss claims arising from the breakdown of the Vehicle, fair wear and tear excepted, or any accident or other such related causes.

Open Road Scotland shall not be liable for any costs and expenses incurred for speeding, parking fines, congestion charges and for any other offences committed against the Road Traffic Act or traffic regulations or otherwise.

The Hirer shall be solely responsible for the costs of repair and or replacement as necessary in relation to damage to windscreen, tyres and punctures.

Car Parking

Car parking (at the risk of the Hirer) is offered free of charge to the Hirer at the premises of Open Road Scotland for the duration of the Vehicle rental period.

Other Terms

Open Road Scotland reserves the right to vary rates, conditions and specification without notice. Open Road Scotland also reserves the right to refuse hire to any person.

No failure or delay by Open Road Scotland in exercising any right, power or privilege under these terms and conditions shall operate as a waiver nor shall any single or partial exercise preclude any further exercise of any right, power or privilege under these terms and conditions or otherwise.

If any provision of these terms and conditions shall be found by any court of competent jurisdiction to be invalid or unenforceable in whole or in part, such invalidity or unenforceability shall not affect the other part of that provision or the other provisions of these terms and conditions which shall remain in full force and effect.

The interpretation of these terms and conditions and all rental agreements entered incorporating these terms and conditions shall be governed by and construed in accordance with the law of Scotland and the parties agree to submit to the exclusive jurisdiction of the Scottish courts.

 

Terms of booking on this website

The following terms relate to the booking service provided to you by Motorhome Republic. The booking service includes the Motorhome Republic site, the software associated with the site and the facility to enter into transactions with certain parties whose content appears on the site. You agree to these terms with us in respect of the booking service, in addition to the terms of your rental above which apply directly between you and your chosen third party travel provider (“Third Party Provider”).

Information disclaimer

The rates on this website are often heavily discounted. This is due to our negotiated rates and bulk buying power. On very rare occasions, a rate may be displayed incorrectly due to our, or a Third Party Provider’s error. In such a case, if you book with us at a quoted rate that is incorrect, we will notify you of any price change and give you the option to proceed or cancel. We make every effort to keep information on our site up to date, but we cannot guarantee this website is free of errors or omissions and retain the right to update or change the information published at any time.

Liability

To the extent permitted by law we/the owners of this website will not be liable to you or to any third party (whether in contract, tort, or otherwise) for any direct, indirect or consequential loss or damage or for any accident, injury, delay or loss of enjoyment arising out of your reliance upon information contained on this website, including but not limited to your use (or inability to use) any products or services described or procured through this website.

Your rental and use of a vehicle booked through our site will be governed by the terms of the rental agreement with the Third Party Provider. The rental agreement and any other documentation provided to you by the Third Party Provider is between you and the Third Party Provider and we will not be liable to you or to any third party in any way in relation to that agreement or your vehicle or rental service where your booking has been properly processed by us. We are not responsible or liable to you for (i) the acts or omissions of the Third Party Provider in respect of your booking or in the course of delivering the rental service to you; or (ii) any disputes in respect of your booking with that Third Party Provider or that service, except in each case to the extent that responsibility for those matters may be imposed on us by applicable law. While we will make reasonable efforts to ensure we are representing only reputable Third Party Providers, we make no warranty about the fitness suitability of any Third Party Provider product or service and will not accept responsibility for the quality fitness of any vehicle. If you encounter issues with the vehicle whilst on hire, you MUST report these issues directly to the relevant Third Party Provider at the earliest possible time. This will allow the Third Party Provider to remedy any issues and minimise any inconvenience to you. If you fail to report any vehicle issues during your rental, it is likely that compensation will not be offered. We welcome feedback from our customers on their experience with our Third Party Providers. We may, at our discretion, provide you with reasonable assistance in resolving any dispute you may have with a Third Party Provider. Where we are liable to you terms and conditions, our total liability to you will be limited to (at our option) resupply of the booking service provided to you or the dollar amount of the deposit we received from you in relation to your booking. Again, we strongly recommend that you take out travel insurance. Your use of this website is governed by the laws of New Zealand and the jurisdiction of the New Zealand courts.

Booking information

To make a booking you must complete our booking form which is easy to follow and secured with the latest encryption technology. Once we receive your form, we will availability confirm your booking email you a confirmation voucher and invoice. The deposit required to secure your vehicle (as shown on the secure booking page) will only be processed on your credit card when your booking is confirmed. Please note that a 2% credit card or debit card surcharge will be added when your payment is processed. A booking is confirmed when you have been emailed a confirmation voucher and at this stage the deposit is processed on your card and becomes non-refundable and any cancellation fees stated in the Third Party Providers terms apply. Upon receipt of your confirmation, please check your details carefully and notify us immediately if there are any incorrect details, as it may not be possible to make changes at a later date. If you are booking via phone, please make sure you have read the terms and conditions of the vehicle you wish to rent first. Our reservations consultant will ask you if you have read the terms and agree to them before proceeding. The onus is always on the renter to ensure they make themselves fully aware of the terms displayed on our website.

Information disclosure

In booking on this website you acknowledge that we disclose your information to your selected Third Party Provider in order for them to provide the requested rental services to you.

Amendments

Please note that some Third Party Providers treat an amendment as a new booking and apply the rate current at the time the amendment is made to recalculate the entire booking amount (not just the days changed). If the rental period is increased, an additional deposit may be required. If the rental period is shortened which results in a reduction of the rental charges, the deposit amount will remain unchanged, and the difference between the original and revised deposit is forfeited (it cannot be used towards remaining rental charges). To request a change to a confirmed booking, please use the alterations request link on your confirmation. Any alterations are subject to availability and the approval of the Third Party Provider. In addition to the alteration policy of the Third Party Provider stated in their terms, the following charges will apply in respect of our booking service relating to that amendment: Motorhome rental alterations (all charges stated in local currency): 25.00 The alteration fee will not be charged if your alteration request is not possible.

Vehicle Capacity and fitness to drive

Under no circumstances are you permitted to carry more passengers than the vehicle you rent is legally registered to carry, and if you do your insurance may be invalidated. The number of seatbelts (and passengers) is indicated next to each vehicle on this website. Luggage capacity where shown is an indication only and we will not be responsible should you be unable to fit your entire luggage into a vehicle. It is your responsibility to choose a journey that is within your capabilities. A Third Party Provider can refuse to rent a vehicle to any person who is in their opinion unfit to drive or does not meet eligibility requirements. In such circumstances we will have no further liability to you.

Refund and Cancellation Policy

We are committed to providing a quality service and aim for complete customer satisfaction. In the event of cancellation, any refunds, credits or cancellation charges that apply are detailed in the terms and conditions of the Third Party Provider of your selected vehicle. In the event you are unsatisfied with our booking service, please contact us within 48 hours of placing your booking or request and we will work to resolve any issues and determine if compensation is due. In the event you have completed your rental and are unhappy with your vehicle, we are happy to assist you in seeking compensation from the Third Party Provider.

Sometimes a booking may need to be cancelled because of circumstances beyond either party’s control. For example, a weather event, public health event (including epidemic / pandemic), medical emergencies, strike, terrorist act, governmental, regional or local authority restrictions (such as restrictions on movement due to the COVID-19 pandemic) or a change in law). If this occurs, your entitlement to a credit or refund will be as provided in your Third Party Provider’s terms and conditions.

You agree that you will raise and resolve any dispute over refunds or cancellations in respect of your booking (whether initiated by you, the Third Party Provider or by circumstances beyond the reasonable control of either party, including as a result of government travel restrictions, the COVID 19 pandemic or the insolvency of your Third Party Provider) directly with the Third Party Provider. Once you have made payment for your booking, you must not seek to reverse or cancel such payment through your card issuer or its agents without our prior consent.

We shall only be liable to provide a refund to you (whether that cancellation is initiated by you, the Third Party Provider or due to circumstances beyond the reasonable control of either party, including as a result of government travel restrictions, the COVID 19 pandemic or the insolvency of your Third Party Provider) to the extent that we actually receive a refund from the relevant Third Party Provider. Where refunds are due to you from a Third Party Provider, we will provide reasonable assistance to you in claiming such funds from that Third Party Provider. In that situation, you authorise us to seek such refunds from the travel provider directly and on your behalf.

Where a refund is applicable, the turnaround time from the date of your request for refund to the date you are provided with your refund may take up to 12 weeks. This is beyond our control.

We are not responsible (including in negligence) to you for any failure or delay on the part of any Third Party Provider in providing travel products to you where the booking has been properly processed.
